Terms & Conditions
1. Scope of Services
Hotel Art Solutions provides structured artwork programmes for hotels, including guest room and public-area artwork, delivered as fixed installations or rental and rotation programmes as agreed in writing. All services are provided on a project or programme basis and are subject to written proposal acceptance.
2. Proposals and Acceptance
All proposals are indicative until confirmed in writing. A project is deemed accepted once written approval is received confirming scope, pricing, delivery model, programme timelines, and applicable terms.
3. Pricing and Payment
Pricing is project-specific and dependent on scope, artwork quantities, delivery model, and installation requirements. Payment terms are defined within the approved proposal. Unless otherwise stated, invoices are payable within the agreed payment period.
4. Artwork Specification and Approval
Artwork specifications, including sizing, framing, finishes, quantities, and placement, are defined at programme level and approved prior to production. Once approved, specifications may not be altered without written agreement and may result in revised pricing or timelines.
5. Delivery and Installation
Delivery and installation are scheduled in alignment with refurbishment programmes and site access availability. Hotel Art Solutions shall not be liable for delays caused by third-party contractors, restricted access, changes to refurbishment schedules, or force majeure events.
6. Rental and Rotation Programmes
Where rental or rotation programmes are selected, artworks remain the property of Hotel Art Solutions unless otherwise agreed in writing. Rotation schedules, refresh cycles, maintenance responsibilities, and programme duration will be defined within the approved programme documentation.
7. Damage, Loss, and Insurance
Responsibility for artworks transfers upon delivery or installation, as agreed. Any damage or loss must be reported promptly. Rental programmes may include replacement or maintenance provisions, as defined within the programme agreement.
8. Intellectual Property
All artworks, designs, imagery, and programme materials remain the intellectual property of Hotel Art Solutions or its licensors. No reproduction, reuse, or distribution is permitted without prior written consent.
9. Limitation of Liability
To the fullest extent permitted by law, liability is limited to the total value of the agreed programme or services provided. Hotel Art Solutions shall not be liable for indirect, consequential, or economic loss, including loss of revenue or business interruption.
10. Force Majeure
Hotel Art Solutions shall not be liable for failure or delay in performance resulting from events beyond reasonable control, including but not limited to acts of God, pandemics, supply chain disruption, strikes, governmental action, or transport failures.
11. Termination
Either party may terminate an agreement in accordance with the terms set out in the approved proposal. Costs incurred up to the date of termination remain payable.
12. Dispute Resolution
In the event of a dispute, the parties agree to seek resolution through good-faith negotiation prior to initiating legal proceedings. Where resolution cannot be achieved, disputes may be referred to mediation or arbitration by mutual agreement before litigation.
13. Governing Law and Jurisdiction

For projects contracted with clients based in the Republic of Ireland, these Terms & Conditions shall be governed by the laws of Ireland, and the courts of Ireland shall have exclusive jurisdiction.
14. Amendments
These Terms & Conditions may be updated periodically. The version in force at the time of proposal acceptance shall apply.
